These policies apply to the use of our educational programs and our services such as our skill support  services.  We appreciate your patience in reading through them before we complete your transaction.  Because of the sensitive nature of the services provided on this website it is important for us to advise our customers of these issues.

All visitors and participants of this website must adhere to these "terms of agreement". Please read them carefully.

To be a participant on this website you must be at least 18 years of age or a minor whose parent is allowing you to use the site. 

If you register with us you agree to provide accurate and current information about yourself.  If you take one of our programs as a court ordered participant you agree to provide any required documentation to prove that you actually did the work to complete the program.  You agree to update information about yourself if it changes. You understand that we have a system to determine that the court ordered person actually took the course and that this will be divulged towards the end of the program and before completion documentation will be supplied. If there is a credible concern (as determined by the tester) that the court ordered person did not do the work, completion documentation will not be supplied and the court will be advised of our concerns.

When you register for a program you will be given a password to complete the testing.  You agree that you are solely responsible for the security of this password.  You agree that if you believe the confidentiality of your password has been breached you will immediately advise this website.  You further agree to not hold Nonviolence Education.com liable for any losses you suffer as a result of your failure to take steps to maintain the confidentiality of your password.

You agree that any credit card information you give us will be accurate.  You understand that we will wait until we receive authorization and approval on your credit card purchase before we will ship the product or arrange for download of the product to you.  All fees will be paid in US dollars.

You agree that Non Violence Education.com has the right to change their fees or prices at any time.  Please refer to our refund policy later in this section.

We will not acknowledge or respond to any communication from a participant  if it is considered by us to be unlawful, harassing, pornographic, abusive, threatening, obscene, libelous, defamatory, inflammatory, vulgar, invasive of another's privacy, violent or racially, ethnically or otherwise discriminatory.  We will reserve the right to cancel the offending parties' right to the use of this website. This policy will of course apply to the use of any of our services such as e-mail correspondence and skill support  services.

You agree that you will not do any of the following:

  • Attempt to copy or otherwise use any content you acquire from this website for resale or in any way which infringes on property rights, privacy rights or other proprietary rights of others.
  • Attempt to disrupt the NonViolence Education.com site or services in any way or attempt to compromise our ability to transmit over the internet.
  • Transmit any content containing viruses, trojan horses, worms, time bombs or any other harmful entity.
  • Attempt to gain unauthorized  access to NonViolence Education.com's site for the purpose of accessing other's accounts or passwords.
  • Attempt to extract any unauthorized data or data fields.
  • Collect information about others without their consent.
  • Provide false information on your registration form or attempt to mislead NonViolence Education.com regarding your identity.
  • Interfere with anyone's use of or enjoyment of the website.
  • Harm minors in any way.

Our website may provide for your convenience links to other websites which may be of interest to you or is related to our message.  You understand that NonViolence Education.com is not responsible for these other websites in any way.  You understand that because we provide this link it does not mean that NonViolence Education.com condones or otherwise endorses all content or methods of doing business of that other website.  You agree that any business relationship you establish with these other websites is totally separate from your business relationship with NonViolence Education.com and you agree to hold harmless any grievances you might have with this other website.

You agree that either you or NonViolence Education.com may terminate or cancel our business relationship at any time.  Please refer to our refund policy later in this section.

I understand that there may be occasional interruptions to service for maintenance and updating of the site, or for unexpected reasons such as power outage, internet outage, fire, flood, etc.  Nonviolence Education.com will do everything in its power to minimize these interruptions. Nonviolence Education.com shall not be liable for the failure to perform any of its obligations under this agreement if such failure is due to the occurrence of an event beyond it's reasonable control.

I agree that if any provision of this agreement is found to be illegal, unenforceable, or invalid, that provision shall be limited to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect.

Nonviolence Education.com  makes no warranties that the services provided or the products received will meet all your expectations.  You agree to accept any product ordered "as is".  You understand that we shall not be responsible for any damage to your computer or loss of data that results from the download of any of our products.  You agree that Nonviolence Education.com shall not be liable for any direct or indirect damages including but not limited to loss of profits, goodwill, data or intangible losses resulting from the use of goods, data, information or services.

You understand that the information available on this website is drawn from many sources including the positions of our writers.  The information may be disputable by others and represents opinions of many writers which will support our mission.  You agree that these opinions are submitted to you in an attempt to be helpful however you will make the final determination as to whether you apply any of the concepts to your life and you understand that Nonviolence Education.com is in no way suggesting that you use any of our information.  You agree to hold Nonviolence Education.com harmless for any problems or difficulties that may occur as a result of your choice to use our materials or services.

You understand that Nonviolence Education.com offers no guarantee of outcome from the use of our products or services.

You understand that all materials and services of the Nonviolence Education.com website are psychoeducational in nature and are in no way intended for or being promoted as a substitute for psychotherapy.

You agree that any disputes or claims arising out of or related to the service or this agreement shall be settled by binding arbitration.  You agree that any claims must be filed within one (1) year of the time such claim arose, regardless of any law to the contrary otherwise such claim shall be barred forever. 

You understand that arbitration will not apply if (1) Nonviolence Education.com must file a temporary restraining order due to harassment or threatening behavior from a participant or (2) Nonviolence Education.com is attempting to collect past due fees.

You agree not to transfer, copy or upload any content from this website which infringes on trademark laws, copyright laws or other proprietary rights of any party whatsoever.

You agree to comply with all local, regional, national and international rules of acceptable conduct while using this website.

You understand that these terms will continue to remain in force for any time in which you are a participant on this website.  If you discontinue use of the website and return it will be your responsibility to reread the terms for any changes or additions.  The terms of agreement posted on any given day will apply to your use of the website on that day. 

 

CONFIDENTIALITY & PRIVACY POLICIES

We place a high value on the confidentiality of the information that our customers share with us through our programs and psychoeducational skill support services.

Personal information you share with us is in general confidential.  The only individuals with access to this information are staff members who are directly involved in providing services to you.  All of these persons are aware of the strict confidential nature of this information. 

If for some reason there is a need to share information in your record with someone not employed here (for example a physician or  a therapist), you will first be consulted and asked to sign a form authorizing transfer of the information.  Because of the sensitive nature of some of the information you may wish to discuss the release of this material and related implications very carefully before you sign.  The form will specify the information which you give us permission to release to the other party and will specify the time period during which the information may be released.  You can revoke your permission at any time by simply giving us written notice.

Exceptions to Confidentiality

There are several important instances when confidential information may be released to others without your permission.  First, if you have been referred to this program by the court ("court ordered"), you can assume the court wishes to receive some type of report or evaluation.  In general we will not release such a report without your permission unless the court contacts us directly for a status update of your progress in the program.  As long as you are handling your responsibilities with the court and are up to date with them this should not be an issue.  However if you are not up to date and the court contacts us we will be required by the court to release a general report as to your status in the program.  You should discuss with us exactly what information we would include in such a report to the court.  It is possible that an individual could be terminated from one of our court ordered programs for misconduct within the program or website.  In this case we would have to divulge this to the court if they request a report.  We may be required to release more than just general progress information to a court system if they request it so you should be aware of this before disclosing any confidential information to us. 

By registering with us for a court ordered program you agree that we must divulge information to the court about you.  In general it would include only basic information regarding your progress but if requested or if we have some specific concerns we may have to divulge this as well.

Second, if you threaten to harm either yourself or someone else and we believe your threat to be serious, we are obligated to take whatever actions seem necessary to protect people from harm.  This may include divulging confidential information to others, and would only be done under unusual circumstances when someone's life appeared to be in danger. 

Finally, if we have reason to believe that you are abusing or neglecting your children or an elder, we are obligated by law to report this to the appropriate state agency.  The law is designed to protect more vulnerable persons from harm and the obligations to report suspected abuse or neglect are clear in this regard.

In addition, please be advised that if your records are subpoenaed for some court purpose we are required by law to release them.

 

IN SUMMARY:

The following circumstances are exceptions to the normal confidentiality laws.  In these instances either the courts (if court ordered) or most state laws require us to report certain information to the appropriate person or agency WITHOUT YOUR PERMISSION.

  • Your progress in the program (if court ordered or subpoenaed)
  • Concerns or reasons for termination from the program (if court ordered or subpoenaed)
  • Any use of violence or threats
  • Any child abuse or neglect
  • Any elder abuse or neglect
  • Any suicidal/homicidal ideation/threats

If court ordered, this information may need to be shared with the representatives of the appropriate court system, probation department, parole department, or child protective services.

You agree that you understand the above exceptions to confidentiality.

You understand that if at any time we assess that anyone using our programs is in need of more in-depth counseling, is not having their needs met by online psychoeducational skill support or is breaking one of the above "exceptions to confidentiality" rules, we reserve the right to immediately refer them out to other types of counseling or help and to terminate our working relationship with them regardless of their position in the program.

Other than the exceptions mentioned above, keeping customer information secure is our priority.  We will maintain the highest standards of security and confidentiality whenever possible or appropriate.

Other than the exceptions mentioned above we will not reveal customer information to any external organization unless authorized by the customer or unless it is required by law (see above exceptions)

PROGRAM REFUND POLICY (Including any of our available programs - anger management, family violence, parenting)

There will be no refund for the portion of the program fee that represents the cost of the workbook for the same reasons listed on "policy product" page.

Partial refunds are available for the portion of the program fee that represents program. The customer may, upon request, obtain a refund for only the portion of the fee that represents hours/sessions not completed. If the customer has completed testing on any topics (hours/sessions), he or she will not be eligible for a refund on that portion of the fee. This is because nonviolence education.com will have had to process that work. Instead the customer will receive a progress report indicating completion of those hours/sessions completed. Customer will not receive a completion for the entire program unless he or she completes the entire court requirement.

A full refund for the program portion of the fee will never be available if the customer has completed testing on any of the topics (hours/sessions) even if the court decides to not grant him or her credit for any of the work. This is because it is the responsibility of the customer to get approval from the court to use the nonviolenceeducation.com program before starting.

 

EXCEPTION TO PROGRAM REFUND POLICY - If the program is not being administered by Nonviolenceeducation.com, such as a therapist purchasing the program to use with clients, there will be no refund of program fees once the testing password has been given to the buyer.

 

SKILL SUPPORT SERVICES REFUND POLICY

There will be no refund on skill support services once the service is provided.

 

You also understand that we do not guarantee your court will accept our program to meet your requirements.  Although many courts have accepted online programs in the past it is your responsibility to verify this.  Please see our information to the court page which you may print out and give to your court for approval.

 

We recommend that you save or print out a copy of these Terms of Agreement for your reference.
